focus of this position is to provide immigration legal consultations and direct representation on cases derived from consultations, referrals, or as assigned. Additionally, the incumbent serves as manager of the ILS program. ESSENTIAL DUTIES AND RESPONSIBILITIES Consults with clients throughout the Rocky Mountain region one-on-one and in a clinic setting to determine legal options and eligibility for various forms of immigration benefits including, but not limited to, adjustment of status, naturalization, employment authorization, and family reunification.
Handles ongoing representation of cases derived from consultations in compliance with grant requirements and under the direction of
the Legal Services Director. Prepares applications and supporting documentation to be filed with United Stales Citizenship and Immigration Services (USCIS). Maintains accurate and complete case files.
Advises, prepares, counsels, and represents clients in cases before United States Citizenship and Immigration Services (USCIS) for naturalization interviews, and in limited cases, for adjustment of status interviews. Manages, trains and coordinates ILS program staff including but not limited to, the legal aide, paralegals/Department of Justice (DOJ) Accredited Representatives, legal volunteers, and law student interns. Supervises legal volunteers, including law student interns and attorneys.
Directs the development of ILS program-specific strategies and oversees the efforts of program personnel in implementing these strategies.
Assists with grant writing, management and reporting. Effectively conducts public community outreach presentations on immigration issues. Serves as liaison with private bar, governmental agencies, and other non-profit organizations. Develops and maintains close collaborations with other nonprofit, government or private agencies. Job Duties Provides a variety of direct legal support assistance services to serviced AUSA staff. Typical assignments include: Examines, prepares, and processes a variety of technical legal documents that are characteristically voluminous and complex in format. Reviews incoming material and independently determines the need for assembly and preparation of a variety of legal documents, e. g. complaints, motions, orders,
answers, pleadings, and subpoenas. Obtains needed information from files, law enforcement agencies, or other sources, and submits completed legal documents to the appropriate AUSA or, in limited cases, directly to the court.
In preparation of documents, considers the nature and the status of the case involved. With limited instructions from the AUSA, prepares such legal actions as indictments, criminal complaints, search warrants, judgments, applications, notices, affidavits, summonses, grand jury subpoenas, rules to show cause, proofs of claim, and satisfaction of judgment. Completes variable aspects of preparing recurring legal documents that conform to the rules governing their style
and format. Provides assistance to attorneys in trial preparation by performing duties such as independently compiling trial notebooks, assembling jury instructions, and compiling witness and exhibit lists.
Coordinates with the victim/witness specialist to ensure adherence to current Departmental guidelines relating to victims' rights and services responsibilities. Notifies appropriate individuals of victim/witness issues. Using original and online legal resources, verifies citations and statutory references contained in legal documents. Ensures citations are complete and consistent with source material. Develops tables of contents and indices to briefs in accordance with established format.
Lists cited cases, opinions, and miscellaneous references in briefs. Composes original letters that require a good working knowledge of legal procedures and specialized terminology, e. g. transmittal of pleadings, requests for extensions of time in certain cases, advising of actions taken or developments in cases referred by other federal departments and agencies, and notices to attorneys representing defendants. Scans/inputs and links case-related materials into an electronic database and manages that database. Manages discovery and trial preparation.
Provides a variety of ancillary office support functions requiring some subject-matter knowledge of the assigned unit's programs and operations. Typical assignments may include the following: Assembles the physical files for new immigration cases by filing materials in chronological order, preparing and printing conflict of interest sheets for assigned attorney, and numbering the initial discovery. Upon receipt, sends additional discovery to outside parties as directed by the assigned attorney. Prepares immigration files for closing by putting the documents in chronological order, ensuring that the judgment and charging document are in the file, and preparing a closing sheet for the assigned attorney's signature.
Assists support staff members by pulling files for court after checking the next day's court calendar and ensuring that all files are accounted for. After files are received back from court, sorts, and distributes them to the appropriate staff members.
