This is a highly responsible in-person attorney position that will serve in the capacity of providing legal services to the Division of Children's Medical Services (“CMS”).
CMS is a collection of programs that serve children with special health care needs This position is responsible for providing legal guidance to CMS regarding the application of state and federal statutes and regulations governing various activities of Children's Medical Services, including the Children Medical Services Managed Care Plans and Medical Foster Care Programs. The incumbent will handle
all litigation matters and provide clear and consistent counsel to CMS regarding pending litigation, legislative analysis, rule drafting, subrogation liens, subpoena responses, discovery, witness preparation and the protection and redaction of confidential information.
The incumbent is responsible for preparing written legal documents including memoranda, correspondence and litigation pleadings, while incorporating interpretation of federal and state statutes, administrative rules, and court decisions. The incumbent will consult with and advise personnel on a variety of legal issues, requiring thorough research, in a timely and efficient manner. Incumbent will review all policies and
procedures applicable to assigned headquarters activities and programs for legal implications, including the policies' relationships to federal and state laws.
Performs other tasks as assigned by the Chief Legal Counsel, Deputy General Counsel or General Counsel. Required Knowledge, Skills, and Abilities: The incumbent should be knowledgeable in conducting legal research, analysis and drafting. Qualifications: Must be a member of the Florida Bar in good standing. Litigation experience is preferred but not required. Attorneys with prior experience in either litigation, reviewing policies and/or bill analysis are encouraged to apply. Attorneys skilled in effectively conducting legal research and providing accurate, timely legal opinions are also encouraged to apply.
