counsel to insureds, construction workers, first responders, other witnesses, and from experts such as engineers, consultants, and health care practitioners, to fully and accurately backss the causes and extent of each loss and to maximize opportunities to transfer the loss via rights of additional insured status and contractual indemnification from others.
Use knowledge of construction and CGL insurance practices in the New York construction market, particularly as driven by risk transfer and avoidance strategies of insurers that are related to New York's Labor Law vicarious liability statutes, to successfully shift duty to defend and indemnify to downstream contractors and carriers.
Retain defense counsel and coverage counsel as necessary and work effectively with them. Manage all phases of the claims for New York bodily injury and property damage lawsuits from intake and investigation through litigation and resolution by mediation or other settlement Participates in negotiations, conferences and mediations with adjusting companies, outside legal counsel, staff, claimants, brokers, insureds, carrier and other involved parties Conduct coverage analysis on new and existing matters.
Draft coverage opinions in collaboration with Claims Counsel Establish appropriate loss estimates based on all relevant information and findings and recommend reserves. Draft and complete
claims management status reports or the equivalent to clients on a quarterly basis, or as needed.
Manage and gather data for reporting on monthly Bordereau. Make timely and accurate file notes and time and expense records as required Education/Skills/Experience required: 1 or more years of CGL insurance or risk management involving CGL and liability umbrella insurance experience Ideally background in handling CGL bodily injury and property damages claims, including bodily injury claims under New York Labor Law Bachelor's degree required. GL adjuster license required. J. D. preferred but not required Strong with MS Office applications (Outlook, Word, Excel, Power Point) Strong client advocacy and interpersonal skills Demonstrated decision making and problem-solving skills Excellent organizational, project management and leadership skills.
